Terms and conditions

1. Who we are
Nutrition Magician is run by Robert Spencer, trading as Nutrition Magician. You can contact us at admin@nutrition-magician.com. Our postal address is shown once you have created an account, and on the page where you subscribe, before you pay. You can also email us for it.
These terms are the agreement between you and us when you use Nutrition Magician. Please read them with our privacy and cookies policy, which explains what we do with your information.
2. Joining
- Membership is for people aged 18 or over who live in the United Kingdom.
- Your account is for you alone. Please don't share your log-in details, and keep your password safe. If you think someone else has used your account, change your password and tell us.
- The details you give us, such as your email address, must be correct and kept up to date.
3. The price and paying
- Membership costs £5.99 a month. There is no free trial.
- You pay by card through Stripe, our payment provider. Your first payment is taken when you join, then the same day each month. We never see or keep your card details.
- We are not registered for VAT, so no VAT is added.
- If we change the price, we will email you at least 30 days before it applies to you, so you can cancel first if you wish.
- When you join, we email you a confirmation of your membership. After that, we email you a reminder every 6 months that it is still running, a few days before a payment. If you cancel, we email you to confirm it and the date your membership ends.
- If a payment fails, Stripe will try again over the following days. While a payment is outstanding, we may pause your access until it is paid.
4. Cancelling
- You can cancel at any time from your account page (Billing). You keep full access until the end of the month you have paid for, then your membership stops and nothing more is taken.
- We don't give refunds for part of a month.
- Your 14-day right to cancel. The law usually gives you 14 days to change your mind about a service bought online. Because membership starts straight away, we ask you to agree, when you join, that it starts now and that you lose that right. The words you tick are: "Start my subscription now. I understand that because it starts straight away, I lose my right to cancel within 14 days for a refund. I can still cancel at any time, and it stops at the end of the month I have paid for."
- None of this affects your legal rights if the service is faulty or not as described.
- If you come back later, your recipes, plans and lists will still be there unless you have asked us to delete your account.
5. Your recipes and what you add
- The recipes, photos, plans and lists you add are yours. You let us store them, show them to you and, if you choose to share a recipe, show it to other members. You can stop sharing or delete it at any time.
- Only add and share what you have the right to. When you joined you agreed: "I won't add or share recipes that are someone else's copyright unless I have the right to. Any recipe I mark as shareable is my own, or one I'm allowed to share."
- Recipes from a book or a website stay the copyright of their author. You can keep them in your own folder for your own use, but they can only be shared or sold if they come from a source of your own that you have marked as shareable.
- We may remove anything that breaks these terms or the law, or that someone tells us breaks their copyright.
6. Selling your recipes
- You can offer your own recipes for sale to other members, at a price between 50p and £1.99. Only recipes from your own shareable source can be sold.
- A member who buys a recipe pays for it with their next monthly payment. Once that payment has gone through, you earn 85% of the price and we keep 15%.
- A buyer can keep and cook the recipe for their own use. They can't share or sell it on.
7. Sharing your link and earning
- Every member has their own link and QR code. When someone joins through it, you earn 5% of every successful monthly payment they make after their first, for as long as they stay a member.
- Your link is only remembered while the person who followed it is on the site. If they leave and come back later, they need to follow your link again, or type your code when they sign up. Otherwise we can't tell they came from you, and we can't add them afterwards.
- If you share your link on social media, please mark the post as an advert (for example with #ad). It earns you money, and UK advertising rules ask for that.
- Share your link honestly and in your own name. You must not:
- send emails, texts or messages to people who haven't asked to hear from you (spam), or add people to mailing lists to promote your link;
- pretend to be Nutrition Magician or to speak for us, for example by using our name or logo as your sender name, email address, social media account, website or advert;
- say things about Nutrition Magician that aren't true, such as promising health results;
- pay or reward people to join, or join through your own link.
- If you break these rules, we may switch off your link, hold back or cancel the earnings that came from it, and close your account. We won't pay earnings that come from breaking them.
8. How your earnings are paid
- Your earnings from sales and from your link are added up and paid once each quarter, when they come to more than £10. Anything less carries over to the next quarter.
- We pay through the Stripe payment link you save on your Subscription and earnings page, and you'll see each payment listed there.
- If a payment that earned you money is later refunded or reversed by the card company, we take that amount off what you're owed.
- You are responsible for any tax due on what you earn.
9. Lifetime memberships
We may give some long-standing members a lifetime membership, with no monthly payment. It is personal to you and can't be transferred. We may end it if these terms are broken.
10. Nutrition, health and allergies
- Nutrition figures are estimates worked out from the ingredients, and will vary with the brands and amounts you use.
- Nutrition Magician helps you plan your meals. It isn't medical advice. If you have a health condition, such as diabetes or coeliac disease, please follow the guidance from your GP, dietitian or care team. But please feel free to utilise Nutrition Magician to help manage the diet your health professional has advised.
- Always check food labels for allergens. Recipes and products change, and we can't promise that a recipe is free from any particular allergen.
11. Prices and spending
Shopping prices and spending totals are worked out from the prices you enter. Shops' prices change, and we don't guarantee any price.
12. Using the site fairly
Please don't try to get into other people's accounts, upset the site's working, copy the recipe collection in bulk, or use the site for anything unlawful. We may suspend or close an account that does, after telling you why where we can.
13. Changes to the site and these terms
- We keep improving Nutrition Magician, so features may change. If we make a change that leaves you worse off, we'll tell you first and you can cancel.
- If we change these terms, we will email you before the change applies. The date at the top shows when they last changed.
14. Our responsibility to you
- We will provide the service with reasonable care and skill. We can't promise it will always be available or free from faults, but we'll put things right as quickly as we can.
- We aren't responsible for losses we couldn't have expected, or for losses to a business.
- Nothing in these terms limits our responsibility where the law doesn't allow it to be limited, such as for death or injury caused by our negligence, or your legal rights as a consumer.
15. Closing your account
To close your account and have your information deleted, email us at admin@nutrition-magician.com. Our privacy policy explains what we have to keep and for how long.
16. The law
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring a claim in your own country's courts. If something goes wrong, please contact us first. We'll always try to put it right.
